chrono6538.com · Retail (non-auction) sales
Version 1.0 · 22 August 2026
1. About us
1.1 This website is operated by Chrono6538 Ltd, a company registered in
England and Wales under company number 12844120, whose registered office
is at Booths Hall, Booths Park, Chelford Road, Knutsford, WA16 8GS, United
Kingdom. VAT registration number GB495892911.
1.2 You can contact us by email at sales@chrono6538.com, by telephone on
+44 (0)7717 710 062, or by post at the address in clause 1.1.
1.3 If we have to contact you we will do so by telephone or by writing to the
email address or postal address you gave us at checkout.
2. These terms
2.1 These terms apply to the sale of goods through chrono6538.com. They do
not apply to lots bought through our auctions at chrono6538.auction or on
any third-party auction platform, which are governed by the Chrono6538
Auction Terms and Conditions.
2.2 By placing an order you confirm that you accept these terms.
2.3 We may amend these terms. The version in force when you place your order
governs your order.
2.4 In these terms, “Consumer” means an individual buying wholly or mainly
outside their trade, business, craft or profession, and “Business Customer”
means any other buyer. Some clauses apply only to one or the other and say so.
3. Our goods
3.1 Unless expressly described as new, all goods sold on this website are
pre-owned. Pre-owned goods will show signs of previous wear consistent with
their age, and the standard of quality you are entitled to expect takes
account of the description, the price and the fact that the goods are second
hand.
3.2 We describe each item in good faith. Product images are photographs of the
actual item unless stated otherwise, but colours, finish and patina may appear
differently on different screens.
3.3 Where an item has been serviced, refinished, polished, resized, or has
replacement or aftermarket components, we state this where it is known to us.
The absence of such a statement is not a warranty that no such work has ever
been carried out on a pre-owned item.
3.4 Watches are supplied with the box, papers and accessories listed in the
product description and with nothing else. Where papers are absent we say so.
3.5 Timekeeping tolerances on mechanical watches vary by movement and by
service history. Unless we state a specific tolerance for an item, we do not
warrant timekeeping to any particular standard.
4. Authenticity
4.1 We authenticate every item before listing. Watches are checked against
manufacturer reference data, movement and case serials, and, where the item
warrants it, by opening the case back for movement inspection. Bags and
jewellery are checked for hallmarks, date codes, construction, hardware and
stitching. Authentication is carried out in house by us; we do not outsource
it to a third-party service.
4.2 Every item is supplied with a Chrono6538 Certificate of Authenticity.
4.3 If, within 12 months of delivery, you establish to our reasonable
satisfaction that an item is a counterfeit, we will cancel the sale and
refund you in full, including original delivery charges and your reasonable
cost of returning the item. To claim under this clause you must:
4.3.1 notify us in writing under clause 18 within that period;
4.3.2 provide a written report from the manufacturer, its authorised
representative, or an independent expert recognised in the field, identifying
the item and the grounds on which it is said to be counterfeit; and
4.3.3 return the item to us in the condition in which it was supplied, free of
any third-party claim or security interest.
4.4 This clause is in addition to, and does not affect, your rights under
clause 12.
5. Your order and our contract
5.1 Our listing of an item is an invitation to treat, not an offer. Your order
is an offer to buy.
5.2 A contract comes into existence only when we send you an email
confirming that the item has been despatched. An order confirmation or
payment receipt issued before that point is an acknowledgement that we have
received your order. It is not acceptance of it.
5.3 We may decline any order. Reasons include: the item is no longer
available; we have identified an error in the price or description; we are
unable to verify your identity or complete the checks in clause 16; we cannot
lawfully ship to your delivery address; or we suspect the order is fraudulent.
If we decline your order we will tell you and refund any payment taken in full.
5.4 Because we deal in single, one-off items, an item may sell through another
channel between your order and our acceptance. Clause 5.3 covers this and no
liability arises beyond refunding you.
6. Price and payment
6.1 Prices are those displayed at the time you place your order, in pounds
sterling.
6.2 Prices include UK VAT where VAT is chargeable. Certain pre-owned items are
sold under the VAT margin scheme for second-hand goods, in which case VAT
is not separately shown and is not recoverable by you. Where an item is sold
under the margin scheme the listing says so.
6.3 Delivery charges are shown separately at checkout and are set out in our
Shipping Policy.
6.4 Pricing errors. We take care to price accurately, but errors occur. If
the correct price at the date of your order is higher than the price stated,
we will contact you before despatch for your instructions. If the pricing
error is obvious and you could reasonably have recognised it as a
mis-pricing, we may cancel the order under clause 5.3 and refund you.
6.5 Payment is taken at the time you place your order. We accept the payment
methods shown at checkout. We accept payment only from an account or card in
your own name.
6.6 Title to an item does not pass to you until we have received cleared
funds in full. Risk passes to you on delivery in accordance with clause 8.
6.7 For high-value items we may require payment by bank transfer rather than
by card, and may require the transfer to clear before despatch. We will always
confirm our bank details to you by telephone as well as in writing. We will
never email you to tell you our bank details have changed. If you receive
such an email, it is not from us — telephone us on the number in clause 1.2
before sending any money.
7. Delivery
7.1 Despatch times vary by item, from 24 hours to 12 days from the contract
coming into existence under clause 5.2, subject to the checks in clause 16.
The despatch time for a particular item is stated in its product description.
Where no time is stated, we will tell you the expected despatch date within
one working day of your order.
7.2 Delivery timescales, carriers and charges are set out in our Shipping
Policy, which forms part of these terms.
7.3 All shipments are fully insured in transit and require a signature. We
cannot deliver to an unattended address, a PO box, or a “safe place”.
7.4 Where you are a Consumer, we will deliver within 30 days of the contract
unless we agree otherwise with you.
7.5 If nobody is available to take delivery, the carrier will leave
information about how to rearrange. If after a reasonable period the item
cannot be delivered and is returned to us, we may cancel the contract under
clause 15 and refund you less our reasonable outbound and return carriage
costs.
8. Risk and inspection
8.1 Risk in an item passes to you when the item is delivered to the address
you gave us and signed for.
8.2 We ask that you inspect the item on arrival and tell us in writing within
48 hours of delivery if it is damaged, incomplete, or not what you
ordered. This helps us make a claim on the transit insurance. Failing to do so
does not affect your statutory rights under clause 12 or your cancellation
right under clause 9, but it may mean the transit insurer will not pay.
9. Your right to cancel — Consumers only
This clause applies only if you are a Consumer. Business Customers should
read clause 10.
The right
9.1 You have the right to cancel your order within 14 days without giving
any reason. The cancellation period expires 14 days after the day on which
you, or a carrier you nominated, take physical possession of the item.
9.2 To exercise the right you must tell us clearly, before the 14 days
expire, that you are cancelling. Email sales@chrono6538.com or write to us
at the address in clause 1.1. You may use the model cancellation form in the
Schedule to these terms, but you do not have to.
9.3 To meet the deadline it is enough that you send your cancellation before
the cancellation period expires.
Returning the item
9.4 You must send the item back to us without undue delay and in any event
within 14 days of telling us you are cancelling. The deadline is met if you
despatch the item before that period expires.
9.5 You bear the direct cost of returning the item. Because of the value
of our goods, you must return it by a fully insured, signed-for service for
the full purchase price. We will tell you the return address and the service
we require when you notify us. If you send an item back uninsured or by an
unsuitable service, the risk of loss or damage in transit is yours.
9.6 Until the item reaches us, it remains at your risk.
The condition it must come back in
9.7 The item must be returned:
9.7.1 in its original packaging, including the outer box, inner box,
protective sleeves, pouches, dust bags and any presentation case;
9.7.2 with everything supplied with it, including papers, warranty card,
certificate of authenticity, links removed at sizing, tags, protective films
and stickers, spare parts, and any accessories listed in the product
description;
9.7.3 in the same condition in which it was supplied, with all protective
films and factory stickers still in place and unbroken; and
9.7.4 not altered, serviced, repaired, polished, engraved, resized, or worked
on in any way.
9.8 Handling beyond inspection. You may handle and examine the item as you
could in a shop — try it on, examine it, check that it works. You may not use
it. If the value of the item is diminished by handling that goes beyond what
was necessary to establish its nature, characteristics and functioning, we
may recover that diminution in value by deducting it from your refund.
9.9 Without limiting clause 9.8, the following typically diminish value and
will typically attract a deduction:
| What happened | Typical effect |
|---|---|
| Watch worn outside the home or worn beyond brief trying-on | Deduction |
| Bracelet sized, links removed and not returned, or pins damaged | Deduction |
| Factory protective films or stickers removed or broken | Deduction |
| Case, bracelet, clasp or crystal scratched, marked or dented | Deduction |
| Jewellery resized, altered, engraved or re-rhodiumed | Deduction |
| Bag carried in use, or corners, base, handles or hardware scuffed | Deduction |
| Perfume, cosmetics, smoke or pet odour on an item or its packaging | Deduction |
| Original box, papers, tags or dust bag missing, damaged or written on | Deduction |
9.10 A deduction under clauses 9.8 and 9.9 will be the amount by which the
item’s resale value has fallen, assessed by us reasonably. We will tell you
the amount and the basis for it in writing, with photographs, before we make
the refund. Where the diminution equals or exceeds the price paid, the refund
may be reduced to nil.
Your refund
9.11 We will refund the price you paid, plus the standard outbound delivery
charge (if you chose a more expensive delivery service, we refund the standard
rate only), less any deduction under clauses 9.8 to 9.10.
9.12 We will make the refund without undue delay, and no later than 14 days
after the day we receive the item back, or, if earlier, 14 days after the day
you supply evidence that you have sent it back.
9.13 We will refund using the same means of payment you used, unless you agree
otherwise. You will not incur any fee as a result of the refund.
When the right does not apply
9.14 The right to cancel does not apply to:
9.14.1 items made to your specification or clearly personalised, including
engraving, bespoke sizing that cannot be reversed, and made-to-order pieces;
9.14.2 sealed goods which are not suitable for return for health protection
or hygiene reasons, if unsealed after delivery — this includes earrings and
any other pierced jewellery supplied sealed;
9.14.3 goods bought at a public auction; and
9.14.4 any other case where the Consumer Contracts (Information, Cancellation
and Additional Charges) Regulations 2013 exclude the right.
10. Returns — Business Customers only
10.1 If you are a Business Customer you have no right to cancel under
clause 9. The Consumer Contracts Regulations 2013 do not apply to you.
10.2 We may at our absolute discretion accept a return from a Business
Customer. Where we do, it is on the terms we specify at the time, which will
normally require return within 7 days, in original packaging, in the condition
supplied, and may attract a restocking charge, which we will tell you before
you return the item.
10.3 Nothing in this clause affects your rights in respect of goods that are
not as described or not of satisfactory quality.
11. Faulty goods — Consumers
11.1 Nothing in these terms affects your legal rights under the Consumer
Rights Act 2015. A summary:
11.1.1 Up to 30 days from delivery — if the item is faulty, you may reject
it and get a full refund.
11.1.2 Up to six months — if the fault cannot be put right by one repair
or one replacement, you are entitled to a full refund in most cases.
11.1.3 Up to six years — if the item does not last a reasonable length of
time, you may be entitled to a repair, a replacement, or some money back.
11.2 In assessing whether a pre-owned item is of satisfactory quality, account
is taken of the description, the price paid, and the item’s age and previous
use, in accordance with section 9 of that Act.
11.3 Normal wear consistent with the item’s age and as described at the point
of sale is not a fault.
12. Warranty
12.1 We provide a 12-month warranty from the date of delivery on the
movement of mechanical and quartz watches sold on this website, unless the
listing says otherwise.
12.2 The warranty covers mechanical failure of the movement in normal use. It
applies only where the item has not been opened, modified, or damaged.
12.3 The warranty does not cover: battery replacement; straps, bracelets,
crystals and external components; water damage where the item was not
described as water resistant, or where seals have not been maintained;
damage caused by accident, misuse, or unauthorised opening, servicing or
repair; loss of water resistance in a pre-owned item; or ordinary wear.
12.4 The warranty is void if the item is opened, serviced or repaired by
anyone other than us or a repairer we have authorised in writing.
12.5 This warranty is in addition to, and does not affect, your statutory
rights under clause 11.
13. International orders
13.1 We ship worldwide. Shipping charges and available destinations are set
out in our Shipping Policy.
13.2 You are the importer. Any import duty, customs charge, sales tax, VAT
or clearance fee levied in the destination country is payable by you, in
addition to the price and our shipping charge. We cannot tell you what these
will be — check with your local customs authority before ordering.
13.3 You are responsible for satisfying yourself that the item may lawfully be
imported into your country. Certain materials, including some exotic leathers,
ivory and coral, are restricted under CITES and equivalent domestic
legislation. Where an item is affected, the listing says so.
13.4 We declare goods at their full value. We will not under-declare, mark a
shipment as a gift, or falsify customs paperwork, and we will decline any
request to do so.
13.5 If a shipment is refused, abandoned or returned because you did not pay
import charges or did not complete clearance, we may deduct our outbound
carriage, return carriage and any charges levied on us from any refund due.
14. Limitation of our liability
14.1 Nothing in these terms limits or excludes our liability for: death or
personal injury caused by our negligence; fraud or fraudulent
misrepresentation; defective products under the Consumer Protection Act 1987;
breach of the terms implied by sections 9 to 11 of the Consumer Rights Act
2015 or sections 12 to 15 of the Sale of Goods Act 1979; or any other
liability that cannot lawfully be limited or excluded.
14.2 If you are a Consumer: we are responsible for loss or damage you
suffer that is a foreseeable result of our breach or our failure to use
reasonable care and skill. We are not responsible for loss or damage that is
not foreseeable, nor for any loss arising because you used an item for a
business purpose.
14.3 If you are a Business Customer: subject to clause 14.1, we are not
liable for loss of profit, loss of business, business interruption, loss of
revenue or anticipated saving, loss of goodwill, loss of opportunity, loss
arising from any change in the market value of an item, or any indirect or
consequential loss; and our total liability in respect of any item, arising
from all claims however caused, shall not exceed the price actually paid to
us for that item.
14.4 We are not liable for any loss arising from your failure to insure a
returned item as required by clause 9.5.
15. Our right to cancel
15.1 We may cancel a contract and refund you in full if: the item is lost or
damaged before despatch; we cannot complete the checks in clause 16; you do
not pay when payment is due; you do not, after a reasonable request, provide
information we need to fulfil the order; or you do not, after a reasonable
request, accept delivery.
15.2 Where we cancel under clause 15.1 for a reason within your control, we
may deduct our reasonable outbound and return carriage costs from your refund.
16. Identity verification and anti-money laundering
16.1 We are an art market participant for the purposes of the Money
Laundering, Terrorist Financing and Transfer of Funds (Information on the
Payer) Regulations 2017 and are required to carry out customer due diligence
in the circumstances set out in those Regulations.
16.2 We may ask you, before or after despatch, for evidence of your identity,
your address, and where required the source of your funds. We may hold an
order until we are satisfied.
16.3 We may decline or cancel an order, and refuse to despatch, where we are
not satisfied as to any matter in clause 16.2, or where we have reasonable
grounds to suspect money laundering, terrorist financing, sanctions breach or
other unlawful activity. Where we do, we refund you in full, save that we may
be prevented by law from doing so or from telling you why.
16.4 We accept payment only from an account or card in the name of the person
placing the order. Third-party payments are returned.
17. Your personal data
17.1 We handle your personal data in accordance with our Privacy Notice at
chrono6538.com/privacy-policy-2/, which forms part of these terms.
18. Complaints and how to contact us
18.1 Any notice under these terms should be sent by email to
sales@chrono6538.com and, where it concerns a claim, also by post to the
address in clause 1.1.
18.2 If something has gone wrong, tell us. Email sales@chrono6538.com marked
“Complaint”. We will acknowledge within 5 working days and give you a
substantive response within 28 days.
18.3 We are not currently a member of an alternative dispute resolution
scheme and we are not obliged to use one. If we cannot resolve a complaint
between us, you remain free to pursue the matter through the courts.
19. Events outside our control
19.1 We are not liable for any delay or failure to perform caused by an event
beyond our reasonable control, including fire, flood, severe weather,
epidemic, war, terrorism, civil unrest, industrial action, failure of
utilities, telecommunications or internet services, cyber attack, theft, or
any act of government including import or export restriction or sanction.
19.2 Where such an event occurs we will contact you as soon as possible. If it
causes a substantial delay you may cancel and receive a full refund.
20. General
20.1 We may transfer our rights and obligations under these terms to another
organisation. You may not transfer yours without our written consent.
20.2 A contract is between you and us. Nobody else has any right under the
Contracts (Rights of Third Parties) Act 1999 to enforce any of these terms.
20.3 If a court finds any part of these terms unlawful, the rest continues in
force.
20.4 If we do not insist that you do something you are required to do, or we
delay in taking steps against you, that does not mean we have given up any
right against you.
20.5 These terms, our Shipping Policy, our Privacy Notice and the product
description for the item you bought are the entire agreement between us.
21. Governing law
21.1 These terms are governed by the law of England and Wales, and the courts
of England and Wales have exclusive jurisdiction.
21.2 If you are a Consumer, clause 21.1 does not deprive you of the protection
of any mandatory provision of the law of the country in which you are
habitually resident, nor of any right you have to bring proceedings in the
courts of that country where that right cannot be excluded by agreement.
